2. Legal Guarantee of Conformity

Consumers benefit from the legal guarantee of conformity provided for under Articles L217-3 and following of the French Consumer Code.

This guarantee applies to new and second-hand goods sold by a professional to a consumer.

The consumer has a period of two years from the delivery of the product to exercise the rights arising from a lack of conformity.

New Products

For a new product, any lack of conformity appearing within 24 months following delivery benefits from the legal presumption of prior existence provided for by law.

Second-Hand Products

For a second-hand product, this presumption applies for a period of 12 months following delivery.

After this period, the applicable legal rules regarding proof shall apply.

3. Solutions in the Event of a Lack of Conformity

When the conditions of the legal guarantee are met, the consumer may request that the product be brought into conformity through repair or replacement under the conditions provided by the French Consumer Code.

The bringing into conformity shall be carried out free of charge for the consumer.

When repair or replacement is impossible, not carried out within the legal timeframe, or when another legal condition applies, the consumer may be entitled to a price reduction or termination of the contract.

4. Guarantee Against Hidden Defects

The customer may also benefit from the guarantee against hidden defects provided for under Articles 1641 and following of the French Civil Code, when the relevant conditions are met.

The legal action must be initiated within the statutory period from the date the defect is discovered.

5. Commercial Warranty

No additional commercial warranty applies unless it is expressly stated on the product page or in a document provided to the customer.

Any commercial warranty is provided in addition to legal warranties and does not replace or limit them.

To ensure efficient processing, customers are invited to provide:

• their order number;

• the product reference;

• a description of the issue;

• photographs or videos where these may help with diagnosis.

VALTA acknowledges receipt of the request and communicates the necessary steps for handling it.

7. Returns as Part of Customer Service

When a return is required, VALTA provides the appropriate logistical instructions depending on the product concerned.

Due to the size of trailers, customers are advised not to arrange return transport on their own initiative when VALTA is responsible for covering the costs under a legal warranty.

8. Exclusions Not Covered by a Lack of Conformity

Subject to mandatory legal warranties, coverage may not apply when the issue results exclusively, in particular, from:

• normal wear and tear;

• use contrary to applicable instructions or recommendations;

• unauthorized modification or alteration that caused the damage;

• an accident or external damage occurring after delivery;

• a defect of which the customer was expressly informed before purchase under the conditions provided by law.

These situations are assessed on a case-by-case basis and cannot result in the removal of legal warranties when their conditions are fulfilled.

9. Costs

When bringing a product into conformity falls under the legal guarantee of conformity, it shall be carried out free of charge for the consumer under the conditions provided by applicable regulations.
